Serving size reference

Your serving size is not a choice. It is derived from the reference amount customarily consumed for your product category, and every category is in one table in the regulation. All 140 reference amounts are reproduced below, grouped exactly as the CFR groups them, with the label statement pattern FDA specifies for each.

How a reference amount becomes a serving size

Find your category in the table. Take its reference amount. Then convert: for discrete units, the serving is the number of whole units nearest the reference amount; for bulk foods, it is the household measure nearest the reference amount, in the increments the regulation permits.

Cups, tablespoons, or teaspoons shall be used wherever possible and appropriate except for beverages. For beverages, a manufacturer may use fluid ounces. Cups shall be expressed in 1/4- or 1/3-cup increments. Tablespoons shall be expressed as 1, 1 1/3, 1 1/2, 1 2/3, 2, or 3 tablespoons. Teaspoons shall be expressed as 1/8, 1/4, 1/2, 3/4, 1, or 2 teaspoons.

Two thresholds then decide the label format. Under 200 percent of the reference amount, the whole container is one serving. From 200 to 300 percent inclusive, you must use a dual-column label showing per serving and per container. Above 300 percent, normal per-serving labelling resumes.

What is a reference amount customarily consumed?
The RACC is the amount of a food category that FDA has determined people customarily eat at one time. It lives in the table at 21 CFR 101.12(b) and it is the starting point for a serving size, not the serving size itself. You take the RACC for your product category and then convert it to the household measure your product actually comes in, following the procedures in 21 CFR 101.9(b).
So the serving size is not just the reference amount?
Correct. For products in discrete units — cookies, muffins, bars — the serving size is the number of whole units closest to the RACC, subject to specific rules in 21 CFR 101.9(b)(2). For bulk products the serving is expressed in cups, tablespoons or teaspoons, and 21 CFR 101.9(b)(5)(i) requires cups in quarter- or third-cup increments and tablespoons only as 1, 1⅓, 1½, 1⅔, 2 or 3.
Can I pick a smaller serving size to make the calories look better?
No. The serving size is determined by the reference amount for your product category, not chosen. That was the point of the 2016 revision — a 20 ounce bottle of soft drink stopped being 2.5 servings and became one, because that is how people drink it. Understating a serving size to reduce the numbers on the panel is misbranding.
What if my product spans two categories?
21 CFR 101.12(f) says that if a product could reasonably fall into more than one category, the reference amount for the category that most closely matches the product applies. Where a product is genuinely a new type, 101.12(e) allows the reference amount for the most similar existing category. Write down which one you used and why; that reasoning is what an inspector asks for.
When does a package become a single serving?
When it contains less than 200 percent of the reference amount, per 21 CFR 101.9(b)(6) — the whole container has to be labelled as one serving. Between 200 and 300 percent inclusive you must use a dual-column label under 101.9(b)(12)(i), showing both per serving and per container.
